RESIDENTIAL WASTE AND

RECYCLING COLLECTION AND

ADMINISTRATION FEES

AN ORDINANCE OF THE TOWN COUNCIL OF LEEDS, UTAH, AMENDING ORDINANCE 2020-04, Residential Waste and Recycling Collection and Administrative Fees

WHEREAS Washington County Special Service District No. 1 (hereafter referred to as “District”) was created by the Washington County Commission for the purpose of establishing a program for collection and disposal of solid waste in Washington County, Utah; and

WHEREAS said District previously entered into a Municipal Billing and Collection Agreement, with the Town of Leeds for the purposes stated therein; and

WHEREAS the Town Council of Leeds, Utah obligated itself to pass by Ordinance Residential Waste and Recycling Collection and Administrative Fees; and

WHEREAS all residences located within Leeds’s boundaries are required to pay for basic waste collection, together with administrative fees; and

WHAEREAS only those residences located with Leeds’ boundaries that have not opted out of recycling collection are required to pay recycling and the cost of a recycling container; and

WHEREAS the Town Council of Leeds, Utah held a Public Hearing on Wednesday, December 9, 2020 on Residential Waste and Recycling Collection and Administrative Fees; and

WHEREAS the Town Council of Leeds, Utah approved Ordinance 2020-04 on Wednesday, December 9, 2020 on Residential Waste and Recycling Collection and Administrative Fees; and

WHEREAS the District exercised its right to modify the Fee collected by the District in December 2021 for operation of the Washington County Landfill and District administrative expenses; and

WHEREAS the Town Council of Leeds, Utah held a Public Hearing on Wednesday, February 9, 2022 on the District’s modifications to the Residential Waste and Recycling Collection and Administrative Fees; and

BE IT HEREBY RESOLVED that the Residential Waste and Recycling Collection and Administrative Fees for Section 6. of the Municipal Billing and Collection Agreement approved on July 8, 2020 are amended as follows:

(c) the amount of $4.55 per month per residence, plus an annual increase of $.10 per month per residence, or such other amount as may be reasonably determined from time to time by resolution of District’s Administrative Control Board, for operation of the Washington County Landfill and District administrative expenses,

is replaced with:

(c) the amount of $4.55 per month per residence, plus an annual increase of 2.5% charged monthly per residence, with a special adjustment in February 2022 to a base rate of $5.17, or such other amount as may be reasonably determined from time to time by resolution of District’s Administrative Control Board, for operation of the Washington County Landfill and District administrative expenses,

BE IT FUTHER RESOLVED that this Resolution shall take effective immediately upon passage and approval.
