Town Council Meeting for

May 23, 2018

1. Call to Order:

Mayor Peterson called to order the regular meeting of the Leeds Town Council at 7:00pm on May 23, 2018 at Leeds Town Hall, 218 N Main.

4. Approval of Agenda:

Councilmember Stirling moved to approve tonight’s agenda and meeting minutes of May 9, 2018. 2nd by Councilmember Sheltman. Motion passed in a Roll Call Vote.

5. Citizen Comments:

Dick Higgins indicated there were some concerns over the cottonwoods in Silver Reef by the park not receiving water and he has some extra water if needed.

Town Council discussed it. Antonio will be looking to run a water line for the trees.

LoAnne Barnes indicated she was on a committee when Silver Reef Highlands came to town and they dedicated the park to Leeds. She handed Councilmembers more information on the park.

Dale Barnes, stated he was one of the citizens that put the water in the park to begin with and thanked Council for the road work.

Mayor Peterson, replied, thank you, it did go very smoothly, thanks to cooperation from residents.

6. Announcements:

a. Open fire and fireworks restrictions are in effect

Mayor Peterson there will be no open fires on public lands; Additionally fireworks will only be permitted, 2 days leading up to, on the holiday and one day after the Fourth of July and Pioneer Day and will only be allowed in a Town designated area.

7. Public Hearings:

a. 2018-2019 Tentative Budgets for the General Fund and Capital Improvement Fund

Councilmember Roberts moved to open the public hearing on the2018-2019 Tentative Budgets for the General Fund and Capital Improvement Fund. 2nd by Councilmember Sheltman. Motion passed in a Roll Call Vote.

Councilmember Stirling moved to close the public hearing on the2018-2019 Tentative Budgets for the General Fund and Capital Improvement Fund . 2nd by Councilmember Roberts. Motion passed in a Roll Call Vote.

8. Action Items:

a. Historic Preservation Fund Preservation & Maintenance Agreement

Mayor Peterson, indicated the Town has been awarded $10,000 in Grant money. It is a matching grant that we will be able to use the RAP Tax money on. It will be a total of $20,000 dollars of work to complete and the Town will have to maintain the site for 5 years.

Mayor Peterson asked for a motion to approve the Historic Preservation Fund Preservation & Maintenance Agreement.

Councilmember Stirling, is all this money going to the Leeds CCC Camp?

Mayor Peterson replied $500 is going toward the Silver Reef Museum and $19,500 is going to the CCC Camp.

Councilmember Stirling, does it show anywhere on this agreement the $500.00?

Mayor Peterson, it was in the original application that was approved and submitted.

Councilmember Stirling and the Mayor discussed the application.

Councilmember Roberts, the Town owns property where the CCC Camp is. The Town does not own the Wells Fargo, but the Town has invested in the Wells Fargo building that is owned by the County. I think it is important for the public to understand who the owner of these two properties is.

Mayor Peterson discussed the project further and highlighted that in the past the museum has provided many volunteer hours that went to the Town’s required match.

b. Curb and Gutter Plans and Bid Process

Mayor Peterson discussed the bid process and bids

Councilmember Roberts made a motion to approve the curb and gutter plans, the Main Street curb and gutter plans and bid process and allow the engineer to determine the scheduling of the process. 2nd by Councilmember Stirling. Motion passed in a Roll Call Vote.

c. CIB Planning Grant Application

Mayor Peterson indicated this is the second half of the request from the last meeting to the Metropolitan Planning Organization (MPO) for a $35,000 transportation study grant. If the Town gets the CIB grant, that requires a match, as does the one from the MPO, and each grant could match the other. The Town did get approval from DTEC last Thursday for the $35,000. The Town would have to contribute $1,000 and that would make it so neither of these providers would be the majority provider of funds and the Town could administer both $35,000 grants. The Budget would need to be updated and a Public Hearing on the application will need to be held.

Mayor Peterson asked for a motion to approve the CIB Planning Grant Application. Councilmember Stirling I so move. 2nd by Councilmember Roberts. Motion passed in a Roll Call Vote.

d. Designating restricted area for fireworks

Mayor Peterson indicated we need to designate a restricted area for fireworks. In the past we have used the basketball court in the Town Park.

Councilmember Sheltman made a motion to approve designating the restricted area for the fireworks to be the basketball court. 2nd by Councilmember Stirling. Motion passed in a Roll Call Vote.

9. Discussion Items:

a. Dumpster Days location

Town Council discussed the location for the dumpsters. It was decided to have them located in the right-of-way next to Brett Comas’ property on Cherry Lane

b. Nuisance Ordinance

Town Council and Craig Hall discussed the Nuisance Ordinance. It was decided generally that on private property it would be prosecuted civil and public property criminal. Craig is still working on the Ordinance and recommended naming the Ordinance Code Enforcement instead of Nuisance Ordinance.

Craig Hall discussed chickens and indicated what the Town has now, is not working, and is working on something to present to the Town on the topic.

10. Citizen Comments:

Angela Rohr, I am just curious, are we not having Town Fireworks?

Mayor Peterson, replied we are able to have a Town Fireworks and continued to discuss it with Angela.

Angela Rohr, another issue is about the Curb and Gutter. I still feel like Ensign has not done a good enough job to delineate the water. She continued to discuss it with Councilmember Sheltman.

Angela Rohr, indicated she still would like more leniency when it comes to chickens and good job with the streets.

Darryl Lewis, asked council when the new draft of the Ordinance is complete, to be made public and wondered if the name of the Ordinance changes, would it to start with the Planning Commission.

Darryl Lewis recommended if people want chickens, have their adjoining property owners consent to have them.

Darryl Lewis, with the streets they didn’t do such a good job in front of my house. There is a 10 x 15 patch where the slurry is nonexistent and very thin and they did not blend the two layers very good.

11. Staff Reports:

Councilmember Roberts, indicated he had another meeting with the Solid Waste District and gave an update on the meeting. Subsidies were extended for one month to the recycling company.

Councilmember Roberts, codification is still moving along, the cost will be in the next budget year and it should be complete by July.

Mayor Peterson indicated he attended a DTEC meeting and gave Council an update on the meeting. The Town’s grant application for $35,000 was approved and further discussions were held regarding mass transit to Zion National Park.
